PILOT PUT ON `SCAB' LIST MAY SUE, COURT RULES
A former Eastern Airlines pilot unable to find work after he was placed on a union list of "scabs" during a strike against the airline may sue for damages, the Virginia Supreme Court ruled Friday.The court, in an opinion written by Justice Henry Whiting, ordered pilot Aron F. Krantz's suit against the Air Line Pilots Association and a union member be heard in a lower court.
The union and member Richard W. Nottke had claimed Krantz had no authority to sue over an electronic message Nottke, a New York resident, sent through a union computer system in 1989.
Nottke's message advised fellow pilots that Krantz had dropped out of the Eastern pilots' strike and applied for a job with United Airlines. The message asked ALPA members to "pass the word" that Krantz was a scab, or strikebreaker.
United received more than 300 negative comments about Krantz and subsequently halted job talks with him.
Krantz's name was then placed on an ALPA list of strikebreakers that was distributed to every airline, air freight carrier and pilot training organizations. As a result, Krantz has been unable to get a job as a pilot, he claimed in a suit in Fairfax County Circuit Court. - Associated Press
