HUNTING HILLS GOLF COURSE SUIT HOPES FOR LEGAL EAGLE

Golfers at Hunting Hills County Club could have to play around a legal hazard if the club fails to persuade a judge to invalidate a 100-year-old deed.

It turns out that Hunting Hills' developers had clear title to all but 1.7 acres of the golf course when they built the links in the late 1960s.

The disputed land rests in the fairway of the fifth and sixth holes, according to a motion filed in Roanoke County Circuit Court by Martin R. Willis, an attorney for the private club.

Willis contends that Hunting Hills is now the rightful owner of the two small tracts because it paid taxes and has maintained the property for more than 15 years.

County land records show that one tract containing 1.7 acres was deeded to Martha Davis in 1890 and a second tract containing 0.07 acres was deeded to Dock Cunningham and Lula C. France, Willis said.

Records also show there is no record that Davis, Cunningham or France ever sold their rights to the land, Willis said.

Willis asked the court to deed the land to Hunting Hills, after appointing a guardian to represent the legal rights of any heirs to Davis, Cunningham and France.
