SUIT SAYS CHAINS SELL USED ITEMS AS NEW

Two Dallas attorneys filed a lawsuit Thursday charging that Wal-Mart Stores Inc. and Toys 'R' Us are selling used merchandise as new.

Steve Gardner, a former Texas assistant attorney general, said the practice is widespread and he and plaintiff Marc Stanley will ask the state court in Dallas to certify the lawsuit as a class action.

The suit itemizes products bought by Stanley to validate his concern that the stores regularly and intentionally resold returned goods that were damaged, defective or missing parts.

Both discount retailers issued statements defending their return practices and rebutting the allegations.
