Prince William County Commonwealth's Attorney Paul Ebert said he would seek the death penalty against Lonnie Weeks Jr., 20, of Fayetteville, N.C., on charges of capital murder, use of a handgun in the commission of a felony and auto larceny.
The grand jury also indicted Louis Jefferson Dukes Jr., 21, of Washington, D.C., on first-degree murder and similar weapons and theft charges.
Both will be arraigned today, Ebert said.
Weeks and Dukes are accused of killing Trooper Jose M. Cavazos during a routine traffic stop. The 10-year veteran of the state police was shot five times after he stopped a car for speeding on Interstate 95 early Feb. 24 in Dale City.
Cavazos never pulled his weapon, police said.
At their preliminary hearing last month, state police Investigator J.K. Roland testified that Weeks admitted to shooting Cavazos.
