MAN THOUGHT TO BE HIV-INFECTED INDICTED ON ASSAULT CHARGES

A Pulaski County grand jury has indicted a former Pulaski Correctional Unit prisoner - who told guards he might be HIV-positive - on four charges of inflicting bodily injury on correctional officers.

Frank Darryl Allen, 35, was charged in December after two incidents at the Pulaski Correctional Unit outside Dublin on Dec. 16 and 17.

An Aug. 16 jury trial has been scheduled.

Four guards said they were attacked by Allen when they attempted to handcuff him and that he taunted them with the possibility that he was carrying the AIDS virus.

Two guards were bitten, one lost two teeth from an elbow-blow to the mouth, and a fourth officer was scratched on both hands and sprained his wrist.

The guards said in March that media accounts of the incident had been unclear or not understood by many people, who assume that the guards are now HIV-positive.

They are not, but at least two of the officers will have periodic testing to see if AIDS antibodies show up.

Capt. Steve Montgomery said in a previous interview that the altercation began when Allen was brought to his office on Dec. 16 after Allen had threatened an officer in front of other prisoners.

After listening to Allen's version of the incident, Montgomery told him he would be placed in segregated facilities.

Allen got up from his seat and began to leave the office, so Montgomery and other officers moved to restrain him, Montgomery testified at a March preliminary hearing.

A 15-minute struggle began.

Allen eventually was cuffed and then held in facilities separate from the other inmates.

The following day, guards had to enter Allen's cell because they said he was threatening to start a fire with a pile of clothing, bedding and newspapers.

One officer was bitten on his right shoulder during a struggle when attempts were made to cuff the prisoner.

Allen, who was transferred to the Augusta Correctional Unit after the Pulaski incidents, is serving a 10-year sentence for breaking and entering and grand larceny. His mandatory parole date on that conviction is in June.
