MOONSHINE CASE HEARD IN FLOYD

A father pleaded guilty and a charge against his son was taken under advisement in Floyd County Circuit Court on Friday in a case involving manufacturing alcohol without a license.

Junior Lee Boyd, 46, of Route 2, Stuart, and his son, Lee M. Boyd, 19, were charged in August by state Alcoholic Beverage Control Department agents.

Commonwealth's Attorney Gino Williams said agents found six pots of moonshine on property near the Blue Ridge Parkway about one mile off U.S. 221 near Virginia 860. The Boyds did not own the property, but were there when agents arrived.

The still was destroyed.

No charges were placed against the property owners because it could not be proven they were aware of the still, Williams said.

Junior Boyd entered a guilty plea Friday based on his unwillingness to gamble with a jury trial.

Circuit Judge Kenneth Devore suspended all but 30 days of a one-year jail sentence and fined Boyd $250.

He will report to the Floyd County Jail on Tuesday at 6 p.m. and is eligible for work release during the day.

After serving the 30 days, Boyd will be placed on inactive probation.

The maximum sentence is three years.

The charge against his son, Lee Boyd, was taken under advisement for two years.
