Without comment, the high court Monday rejected Larry Fortensky's argument that police acting on an anonymous tip violated the Constitution's ban on unreasonable search and seizure.
California Highway Patrol officers stopped Fortensky on Oct. 26, 1987, after a caller reported his license number and the location of his truck.
Although Fortensky wasn't driving erratically or violating traffic laws, officers gave him sobriety and alcohol breath tests. He failed and was charged.
Fortensky pleaded no contest to drunken driving and having an open alcohol container in the truck, but appealed his conviction. The California appeals court confirmed it and the state Supreme Court denied a review.
Meanwhile under the sentence, he served three years' probation, paid a $1,178 fine and attended an alcohol abuse program. He met Taylor while both were treated for substance abuse at the Betty Ford Center. They were married in October 1991. A month later, he pleaded guilty to another drunken-driving charge.
