The petition contends that Danny Lee King had ineffective legal representation when he was tried and sentenced for the murder of Carolyn Rogers in 1991.
King was on parole when he and his wife lured Rogers to a vacant home. A Roanoke County jury later concluded that King stabbed, beat and stomped Rogers there and stole her jewelry, checkbook and car.
Last year, the Virginia Supreme Court and U.S. Supreme Court refused to set aside the jury verdict.
In the most recent appeal, a Richmond law firm now representing King is seeking a new trial on procedural grounds, saying he did not receive a fair trial because of ineffective legal representation.
No hearing date in Roanoke County Circuit Court has been set on the petition, which is a routine step in a death-row appeal.
