COMPLEX OWNERS SEEK PROTECTION FROM CREDITORS

Owners of Countryside Apartments have filed for protection from creditors in U.S. Bankruptcy Court in Roanoke.

Countryside, on Highland Farm Road Northwest off Hershberger Road, is owned by a limited partnership of which Westwind Properties of Roanoke is the general partner. Timothy J. Thielecke is general partner of Westwind Properties, according to records filed with the court.

The petition, filed this week, seeks protection during financial reorganization. It did not list precise assets or liabilities but indicated both were estimated as less than $50,000.

The company's lawyer, William K. Lewis of Richmond, could not be reached. Thielecke did not return two phone calls seeking clarification of the filing.

Eight other limited partners in the venture earlier this year filed suit in Roanoke Circuit Court against 18 other limited and general partners, including Thielecke and a business associate, Grant Clatterbuck.

The plaintiffs, mostly doctors in Roanoke and Salem, said they entered the venture as creditors, receiving notes for $700,000.

They contended that their status was changed to that of limited partners without their knowledge. That happened in a reorganization of the apartment ownership, they said.

The plaintiffs asked the court to dissolve the partnership and to investigate for fraud.

The defendants denied the charges and said the plaintiffs knew of the reorganization.
