Cmdr. Thomas R. Miller allegedly knew women were being groped by junior officers on a third-floor patio of the Las Vegas Hilton on the convention's final night, but did nothing to stop it, prosecutors said.
Kelso has said he was at the patio the night before.
Miller's lawyer said two Navy admirals and a commander have given statements placing Kelso in the same area as Miller on the convention's final night.
Miller, 47, is charged with dereliction of duty, obstruction of justice and conduct unbecoming an officer. Jury selection in his court-martial was scheduled to begin Wednesday.
An attorney for Miller made the charge against Kelso in seeking dismissal of charges for "undue command influence." Kelso was among 30 admirals who received non-punitive administrative action for attending the convention. - Associated Press
