The commonwealth's attorney's office decided against taking the matter to a grand jury after studying evidence in the death of Derek Wayne Grubb. Grubb was killed by a bullet fired by another hunter, 18-year-old Clayton Ray Waller of Wytheville.
Game Warden Jim Anders said the Grubb family asked that Waller not be charged.
Grubb was hit in the pelvic area by a 50-caliber musket ball, which severed an artery in his leg. It took rescue workers nearly 20 minutes to reach him because of the rough terrain where the shooting occured.
The victim was not wearing blaze orange.
