Club, Hooters settle lawsuit

A Roanoke nightclub once known as Hooters of Virginia Inc. has agreed to drop that name for good in exchange for the national Hooters restaurant chain's agreement to drop a trademark infringement lawsuit.

Last year, a federal judge in Roanoke ordered Hooters of Virginia - a Franklin Road nightclub known for exotic dancers - to change its name. It did, and now is known as Girls, Girls, Girls.

In addition to seeking an injunction forcing the name change, Hooters of America Inc., a Georgia company, filed a lawsuit to collect all profits the Roanoke business had collected while using its name.

The national Hooters restaurant, known for buxom waitresses in skimpy outfits, had accused the Roanoke nightclub of unfair business practices.

But in a consent judgment filed this week in U.S. District Court in Roanoke, both parties agreed to put the dispute behind them with a settlement dismissing the second part of the lawsuit.

Bankruptcies

Four petitions for bankruptcies with business affiliations were filed this week in the U.S. Bankruptcy Court for Western Virginia in Roanoke. Three are personal bankruptcies that the court listed as business filings because of commercial connections, meaning they could be of interest to business creditors and customers.

Lillian Ann Vandyke of Tazewell, doing business as Slenderizers Fashions, Slenderizers of Richlands, Slenderizers of Tazewell and Cornerstone Fashions, filed for liquidation, listing assets of $5,150 and liabilities of $51,915.

William Eugene Osborne and Sandra Lynn Osborne of Swords Creek, doing business as Slim Line Inc., filed for liquidation, reporting assets of $65,150 and liabilities of $125,432.

David A. Matthews of Salem, a self-employed contractor, filed for liquidation, listing assets of $62,200 and liabilities of $88,422.

Clinch Valley Coal Corp. of Tazewell, filed for protection from creditors during reorganization, estimating assets and liabilities both of less than $50,000.

Macado's goes to Greensboro

Roanoke restaurant owner Richard Macher is expanding his Macado's chain to Greensboro, N.C.. He announced this week that he will open a restaurant in downtown Greensboro in March.

Macher paid $425,000 for a building across from the Greensboro Historical Museum and plans to begin renovations in three weeks. The restaurant will seat 253, he said. Parking will be leased in an adjacent city-owned lot.

Several restaurants have opened in downtown Greensboro in recent years, but few have been successful. Macher said Friday that those past experiences didn't bother him though.

"You've got a huge work force in downtown, several colleges within three miles and lots of neigborhoods nearby," Macher said.

Macher operates seven restaurants in Virginia and West Virginia and one in Boone, N.C.
