NEW YORK TO REFUND MILLIONS TO RETIREES

Seeking to end a five-year legal fight that had angered thousands of retirees, Gov. Mario Cuomo said Monday that the state would refund about $60 million to 10,000 retired federal employees who paid state income taxes that were later deemed unlawful.

The announcement marked a sharp reversal by Cuomo, who as recently as February said that, while refunding the money might be politically popular, the decision should be made by the courts, not him.

But Monday, as he prepares for what his own aides say could be his toughest campaign, Cuomo said he would refund the money.

The governor contended that the prospects for winning litigation over the refunds had dimmed.
