Judge Norman deVere Morrison dismissed identical charges Friday against three other dancers for lack of probable cause, said prosecutor Albert T. Mitchell.
Gary Wayne Housel, 43, and Deanna M. Williams, 23, who are accused of violating a Woodstock town ordinance, will be tried on the misdemeanor charges Dec. 16 in Shenandoah County General District Court.
Lawyer David P. Baugh, representing Housel and his dancers on behalf of the Virginia chapter of the American Civil Liberties Union, had requested dismissal of all the charges on grounds the ordinance was too vague. ``We are very glad that the constitutional rights of those three are protected so far,'' Baugh said.
Mitchell declined to comment on the dismissed charges.
If convicted, Housel and Miller each face a maximum of 12 months in jail and a $2,500 fine.
On the show's first night, Aug. 29, the dancers wore G-strings and flesh-colored Band-Aids to cover their nipples. But they allegedly exposed their genitals to the audience during the Sept. 1 performance.
A member of the citizens' group Shenandoah Coalition Against Pornography obtained warrants charging Housel and the dancers with the violations.
