EX-DEPUTY GUILTY OF ASSAULTING SUSPECT

A former Frederick County sheriff's deputy was convicted of assaulting a suspect after a chase but was not ordered to pay any fine or serve jail time.

General District Judge David Simpson told John S. Bryant, 33, to pay court costs after finding him guilty Monday of the Aug. 15 assault and battery of Antonio Capone, 26.

During the chase that began in Winchester, Bryant was following Capone, who was on a motorcycle, at speeds of more than 100 mph. Capone said he ended the chase by pulling over because he didn't want anyone to get hurt.

Bryant, who has filed a lawsuit to get his job back, said Capone wouldn't cooperate when he told him to get off the motorcycle at the end of the chase.

He said he attempted to kick the bike and Capone over when he refused, but instead kicked Capone. He said he then pushed Capone back with his fist to force him down and kicked Capone in the left thigh about four times.
