CLUB APPEALS TRACK DECISION

The Virginia Racing Commission's decision to award the state's first pari- mutuel racetrack to a businessman with close ties to the Maryland horse industry was arbitrary and should be overturned, according to an appeal filed in Richmond Circuit Court.

The Virginia Jockey Club, one of four failed applicants for the track, filed the 23-page appeal Friday afternoon.

The appeal contends that the commission's decision was based solely on a desire to create a Maryland-Virginia circuit - thus eliminating all applicants but Stansley Management of Ohio, which plans to work with the Maryland Jockey Club in developing the track.

The appeal asks the court to order the commission to revoke its October decision and award the license to the Virginia Jockey Club, led by Middleburg developer James J. Wilson.
