DEPUTY QUITS IN PLEA BARGAIN

A longtime Alleghany County jailer resigned Monday as part of a plea agreement in a sexual solicitation case involving an woman inmate.

The inmate accused Deputy James Kerns Sr., 57, of trying to entice her to perform oral sex while she was incarcerated in January 1992.

Under the plea agreement, charges against Kerns were taken under advisement for six months by Circuit Judge Duncan Byrd.

According to investigators, Kerns didn't deny that he made the comments, but said he was joking.
