The dog's owners, Charlie and Eileen Smith Roeder, say they can't afford the legal bills associated with fighting their condo association for the right to keep her.
``We're looking for somebody who will love her and take care of her,'' Charlie Roeder said.
The Roeders were sued by the Woodlands' condominium association in November because Tristan, an 8-year-old mixed breed, weighs 29 pounds.
The condominium community's bylaws limit dogs to 25 pounds, or less.
When polite reminders failed to bring the Roeders into compliance with the rules, the association sued.
The Roeders won a preliminary round in court in November, but it cost more than $1,000. Round two - the trial - was expected to cost several thousand dollars more.
So now the Roeders are hoping to find someone who will give Tristan a good home.
