But the court also said Wednesday that U.S. District Judge James R. Spencer awarded too much in attorney's fees to the worker, Peggy M. Spicer of Farmville. The three-judge panel sent the issue of fees back to Spencer for review.
In May 1993, Spencer found for Spicer on her claim of sexual discrimination, but a jury rejected her claim of retaliatory discharge from a prison work committee. Later, Spencer awarded $29,794 in attorney's fees to Spicer. The appeals court said he awarded fees as though Spicer won her claim.
