FORMER PULASKI COUNTY HIGH TEACHER INDICTED ON SEX CHARGES

A former Pulaski County High School teacher was indicted Tuesday in Floyd County on charges of sexually abusing a young teen-age boy.

In December, sodomy and aggravated sexual battery charges against Donald C. Smith, 59, of Alum Ridge, were thrown out after a preliminary hearing.

Juvenile Judge J.L. Tompkins III had ruled there was no evidence presented to show force had been used - an element necessary for each of the four offenses to be proved.

But Wednesday, Commonwealth's Attorney Gino Williams took four new charges that do not require proof of force to the grand jury .

The grand jury returned three indictments alleging Smith had unlawful carnal knowledge of a boy in 1992 and 1993 who was between the ages of 13 and 15. A fourth indictment alleges Smith took indecent liberties with the boy in 1992.

Williams said in December that there was no connection between the charges and any of Smith's teaching duties.
