Harry Garrett had argued that Nellie Sue Whitt, 46, deserved a new trial because of insufficient evidence and pretrial publicity.
Garrett was especially concerned about the testimony of Whitt's mother, Vera Horn, who testified that Whitt confessed to hitting and killing Roy Thompson with his pickup truck to collect $100,000 in life insurance.
Whitt, who is incarcerated at the Virginia Correctional Center for Women in Goochland, will be eligible for parole in 2002.
