``I'm glad to have this part behind me now,'' David Smith said. ``I certainly do have mixed feelings and mixed emotions about it, but I guess that's because of the circumstances and the conditions.''
He supports a prosecutor's decision to seek the death penalty for his ex-wife, who is awaiting trial on two murder counts for the deaths of 3-year-old Michael and 14-month-old Alex.
She filed for divorce in September, claiming her husband had cheated on her.
On Oct. 25, she said a carjacker abducted her boys. Nine days later, she admitted she killed the boys by leaving them in her car when she sent it rolling into a lake.
David Smith filed a counterclaim for divorce after the boys' deaths.
David Smith said the destruction of their marriage was caused by Susan Smith's boyfriend, Tom Findlay. Their relationship ended shortly before her Nov. 3 confession.
David Smith said his wife admitted having sexual relations with Findlay during their marriage.
He also submitted a March 9 affidavit from Findlay, who described her demeanor the day the boys died.
``She was upset because David knew, or so she thought, knew some information that he was going to make public that upset her,'' Findlay said. Findlay said that was the last time he spoke to her.
Findlay's deposition did not say what that information was.
Susan Smith was not at the hearing; her trial attorney, David Bruck, said he had no comment.
Findlay's deposition detailed a yearlong relationship with Smith, but said he stopped seeing her in April 1994 at her husband's request.
