FLOYD SHERIFF CANDIDATE CHARGED IN ASSAULT|

A police officer who is running for sheriff in Floyd County has been charged with the assault and battery of a 16-year-old boy.

A charge is also pending against the boy stemming from the July 16 altercation with Hillsville police officer Leonard Howell.

Howell faces a misdemeanor charge in the alleged assault. No hearing date had been set Monday.

Commonwealth's Attorney Greg Goad would not comment on the nature of any charges concerning Jody Bullion, the youth involved in the incident, because Bullion is a juvenile.

Howell will take compensatory time and vacation time until the matter is resolved in court.

Bullion was a passenger in a car stopped by Howell, who suspected the car's driver was under the influence of alcohol, according to Timmy Bullion, Jody's father.

Frieda Bullion, Jody's mother, said Howell was going to charge her son with a curfew violation and send him to the juvenile detention center in Christiansburg if she did not pick him up.

She said an altercation between her son and Howell resulted from a disagreement about plans to transport Jody Bullion to Christiansburg.

Three law enforcement officials were present when the altercation occurred.

Goad said he will not prosecute the case because of the conflict between his two positions - as town attorney and as commonwealth's attorney.

"But hopefully it can be resolved through the court quickly," he said.

Jody Bullion is being held in the Christiansburg center for not going to school nine hours a week, Frieda Bullion said, a condition imposed by youth authorities after an earlier incident involving her son.

She declined to comment on his original conviction.
