Greenbrier County Prosecutor Richard Lorensen said the state Supreme Court's order refusing Tracy Lippard's appeal is expected Friday in Lewisburg. The court refused 5-0 Tuesday to hear her appeal.
Lorensen said once the Supreme Court order is received, he expects Circuit Judge Charles Lobban to order her to report by Wednesday to the Southern Regional Jail in Beckley.
Lorensen said Lippard, 24, of Newport News can petition the Supreme Court for a rehearing within 30 days.
But he said the decision to allow her to remain free on bond was effective only until Tuesday's decision on the appeal.
Lippard's attorney, George Yates of Virginia Beach, said he plans to file more motions and will ask that she remain free on bond until the process is exhausted.
State Supreme Court Justice Franklin Cleckley said in court Tuesday that the high court will not hear ineffective assistance of counsel cases on direct appeal.
``She wants to continue pressing on with appealing,'' Yates said.
Lippard has an unlisted telephone number and could not be reached for comment.
A jury found Lippard guilty in November of two counts of second-degree attempted murder and five misdemeanors. Felony charges of attempted murder with the use of a firearm were dismissed.
She was sentenced in January to two years in prison for a February 1994 attack on the Lewisburg family of Melissa Weikle Scott, who was pregnant by Todd Scott, a former boyfriend of Lippard's.
Lippard crowned her successor as Miss Williamsburg in February 1994, then drove 250 miles to Lewisburg the next day, according to testimony. She said she wanted to confront Todd Scott, who was living at High Point, N.C., but was believed to be visiting the Weikle home.
She was convicted of hitting Melissa Scott's father with a hammer and threatening Melissa Scott's mother with a pistol before the father grabbed her in a headlock.
