Longtime Beatles' producer George Martin says the band's new recording should head straight to the top of the charts - just like old times.

John Lennon's unfinished ``Free As a Bird,'' the first new Beatles song in 25 years, has been revived by the three surviving band members, with Paul McCartney adding new lyrics.

``Ringo plays lovely drums,'' Martin said of the medium-paced ballad. ``The bass playing from Paul is impeccable and George does a blinding guitar solo. The voices of Paul and George are complementing John's beautifully. It's a superb work.''

The song will debut on Nov. 19 on an ABC-TV documentary. Although Martin did not produce ``Free As a Bird,'' he helped put together an anthology of rare Beatles recordings that will be released in the next six months.

A federal judge threw out charges that Kirk Douglas' youngest son disrupted a flight, squeezed an attendant's buttocks and insisted that his dog sit in his lap.

The judge dismissed the case, agreeing to a request from the prosecutor.

``The prosecutor took a second look at it and realized there should be no criminal prosecution,'' said Eric Douglas' lawyer Richard Steingard.

The younger Douglas, 36, had been charged with interfering with the performance of flight attendants' duties through assault and intimidation, and assaulting an attendant.

Douglas was arrested July 30 after the American Airlines flight from New York to Los Angeles.
