A federal appeals court Friday gave a group of grocery stores another chance to pursue price-fixing allegations against several large dairies.
The 4th U.S. Circuit Court of Appeals said U.S. District Judge Jackson Kiser of Roanoke erred when he ruled the lawsuit was barred by a statute of limitations.
Valley Rich Dairy, Flav-O-Rich, Meadow Gold Dairies, Borden and the Valley of Virginia Co-operative Milk Producers Association were sued.
A 1992 Justice Department investigation resulted in three of the dairies pleading guilty to rigging school milk bids. Meadow Gold officials were indicted, but their trial ended with a hung jury.
