The American Trucking Associations is challenging a survey of workplace injuries and illnesses being conducted by the Occupational Safety and Health Administration, arguing the effort is an improper enforcement effort by the agency.
The trucking industry trade group argues that the agency did not follow rule-making procedures and, therefore, does not have regulatory authority to conduct the survey. It is going to a broad cross-section of employers with more than 60 employees.
``This is a question of fairness,'' said Thomas J. Donohue, president and chief executive of the ATA. ``Companies are expected to play by the rules. We have a right to expect that government regulators play by the rules, too.''
The ATA argues that the survey does not differentiate between injuries occurring ``off-site'' and those at the employer's establishment, and that could lead to over-reporting and unfairness for companies targeted for inspections.
