Alcohol apparently was a factor in a fatal all-terrain vehicle accident Tuesday night in Whitetop.
Donald Lee Surber, 33, of Whitetop was killed when the ATV he was driving flipped while negotiating a turn on Virginia 753, ejecting him and his two passengers, state trooper Charles W. Carrico said.
"Due to the weight, the ATV's wheels couldn't turn, causing the vehicle to slide into a ditch," he said.
Sandy Taylor, 19, and David Graham, 45, suffered minor injuries.
No charges will be filed because Surber was the operator of the vehicle, Carrico said.
