The large pile of used tires outside D&T Tire in Redwood is a public nuisance, a Franklin County judge ruled Wednesday.
Calvin Dale Fisher, who runs the tire shop on Virginia 40, was found guilty of the charge in Circuit Court, Commonwealth's Attorney Cliff Hapgood said.
The tires became a much talked-about local issue after residents of Redwood - a small community two miles east of Rocky Mount - filed complaints with the Sheriff's Office about them.
Residents who testified Wednesday told Judge B.A. Davis III that the tires are an eyesore and a health risk because they've become a habitat for mosquitoes and rats.
According to Davis' ruling, Hapgood and representatives of the state Department of Environmental Quality will come up a plan for the proper storage and display of tires at the shop.
Once informed of the regulations, Fisher must abide by them. Davis said he will review the situation in 60 days, according to Hapgood.
Fisher and his wife were also arraigned Wednesday on charges that they illegally dumped tires at a site in Glade Hill, a few miles east of D&T Tire, Hapgood said.
The Department of Environmental Quality is monitoring a second dump site that's closer to the business, he said.
