Philip Morris will pull Marlboro ad in Atlanta

WASHINGTON - Philip Morris Inc. agreed to pull a billboard for Marlboro cigarettes from Atlanta's Fulton County Stadium after the Justice Department charged the ad was an attempt to skirt a ban on televised cigarette advertising.

The disputed billboard will be taken down after the defending world-champion Atlanta Braves play their last home game of the regular season Monday night, the Justice Department said. The agreement guarantees that television viewers won't see the billboard during Major League Baseball's coming playoffs and the World Series, if the Braves make it that far.

The Atlanta billboard flap is an outgrowth of a broader Justice Department assault last year on cigarette billboards in sports arenas and ballparks where they might be seen by TV audiences. The department charged that the billboards represented an effort to get around the 1971 law that banned cigarette ads from the nation's airwaves.

In June 1995, Philip Morris and the government reached an agreement that called for the company to remove billboards from easy view of television cameras in 14 football stadiums, five basketball arenas, and 14 baseball parks.
