A lesbian colonel ousted from the National Guard because of her sexual orientation won't have to wait to be reinstated, a federal appeals court ruled Thursday.
Margarethe Cammermeyer was ordered reinstated June 1 by a judge who said her discharge was based on prejudice and violated her constitutional rights.
The Justice Department had asked the 9th U.S. Circuit Court of Appeals to delay Cammermeyer's reinstatement during its appeal, or at least until the court rules in a similar case involving a Navy sonar instructor.
Justice Department officials in Washington could not be reached for comment. They could appeal to the U.S. Supreme Court.
