Correctional Medical Services, a private medical provider fired by the City Jail last month, claims the jail is illegally keeping company documents and has filed for an injunction in Circuit Court to recover the records.
``CMS has sustained and will continue to sustain irreparable injury resulting from (the jail's) wrongful taking and use of CMS's trade secrets and other proprietary information,'' the company said in court papers.
On June 27, Sheriff Robert McCabe broke the contract with CMS, claiming that medical neglect in the jail had reached a crisis.
He replaced the St. Louis-based company with a medical team from Norfolk Community Hospital. CMS had provided medical care at the jail since August 1989.
Jail officials blamed the firing on the lack of efforts by CMS to contain the threat of infectious diseases, particularly tuberculosis, among inmates. They also blamed CMS' lack of medical follow-up, both in terms of record-keeping and dispensing medications, for the termination of the contract.
CMS is asking the court to hear the case Friday.
