Shaheen Malkamy, the Old Dominion University student charged with stabbing his calculus instructor in front of a classroom of stunned students earlier this month, posted bail of $75,000 Wednesday afternoon.
But the 21-year-old, who said he was born in this country and moved to Iran as a child, is still not free.
Just minutes after Malkamy's relatives gave the court clerk a cashier's check for $75,000 on Wednesday, the Immigration and Naturalization Service told the Norfolk sheriff to hold Malkamy until INS agents picked him up.
``It's kind of like the joke about game shows, where the IRS is waiting for you as soon as you get your money,'' Sheriff's Department spokesman George Schaeffer said. ``Only this time it was immigration instead of the IRS, and they were waiting until he gave the money.''
Malkamy is being held at a federally approved detention facility, but officials would not say where. His preliminary hearing is scheduled for Aug. 10.
Malkamy is charged with stabbing math instructor Carl Panetta in the shoulder on July 7 during class. No motive has been given for the attack.
Malkamy said in his college application that he held dual citizenship - in the United States and Iran. Authorities said he was born in Dayton, Ohio, and moved to Iran when he was about 3.
He moved to Virginia Beach about six months ago and enrolled at ODU.
He moved to the Powhatan Apartments on campus earlier this summer, school officials said.
Malkamy was dismissed from the university after the attack.
At a hearing July 11, Assistant Commonwealth's Attorney David Dayton asked that Malkamy be held without bail, saying there was a threat that he might flee the country.
``I don't believe at this point that we have an extradition treaty with Iran,'' Dayton told Judge Terry D. Huffman.
Huffman decided to set bail for Malkamy on the condition that he surrender his passport and stay away from the ODU campus.
Schaeffer, of the Sheriff's Department, said it's not unusual for the INS to take aliens into custody after they've been arrested, but he does not know the particulars of the Malkamy case.
Immigration officials were not available to comment on how long they expect to keep Malkamy in custody. ILLUSTRATION: Color photo
