Mermaids, a Point Harbor nightclub that features topless dancing, has formally appealed the revocation in August of its permit to operate.
The appeal was filed last week in Currituck County Superior Court on grounds that the revocation by the county's Board of Adjustments was ``arbitrary and capricious.''
The board voted to revoke Mermaids owner Robert F. London's operating permit for misrepresenting his business intentions.
London testified that he would not feature topless dancing and months later brought in semi-nude dancers.
London's attorney, John Halstead of Elizabeth City, said earlier that the Mermaids owner changed his mind after learning that topless dancing was legal in the county.
Mermaids will be allowed to remain open for business until the case is decided in court. Had an appeal not been filed, the club would have been forced to close after next week. by CNB
