The accident happened about 2 a.m. on Interstate 264 westbound just past I-64.
Richard Sorrell, 25, whose exact hometown was not released, had stopped on the shoulder when the 1991 Eagle Summit he was driving was struck in the rear by a 1987 Pontiac Grand Am.
Sorrell's car immediately caught fire and he was not able to escape.
The driver of the Grand Am, Barry J. Silver, 21, a Navy man assigned to the Mount Whitney, was charged with driving while intoxicated. Police said he may face additional charges.
Silver was taken to Sentara Norfolk General Hospital for treatment of his injuries and was later transferred to the Portsmouth Naval Regional Medical Center.
