A Circuit Court judge deferred ruling on appeals made by an Ocean View man convicted of violating the city's nuisance ordinance until the judge can determine whether part of the ordinance is unconstitutional.
Judge Charles E. Poston said Thursday that he would not rule until he receives written arguments on the power that the ordinance gives to police officers and other officials to inspect private property without permission or a search warrant.
Rodney D. Meyer, 37, was cited by city officials for accumulating too much junk, collecting water where mosquitoes can breed and having unlocked refrigerators on his property.
Meyer said he keeps the extra materials around to help him restore dilapidated houses. Meyer said city officials violated his constitutional rights when, on numerous occasions, health inspectors came onto his property without his permission and without a warrant.
