A judge on Wednesday dismissed a charge against a Kempsville High School geography teacher accused of taking indecent liberties with a 16-year-old female student.
Thomas Clouser, 35, was charged in October with asking the student to pose for nude photographs.
Police said Clouser made the suggestion to the 11th-grader after asking her to talk with him following class.
Police said the student told her mother, who alerted authorities.
Juvenile and Domestic Relations Court Judge H. Thomas Padrick, after hearing both sides, ruled there was insufficient evidence against Clouser.
As of Wednesday afternoon, Clouser was still suspended without pay from his teaching position. Teachers accused of such crimes usually are suspended pending trial.
Assistant Superintendent Anne Meek said a decision is expected by Monday on whether to reinstate Clouser and reimburse his lost pay.
