Shaheen Malkamy, the former Old Dominion University student charged with stabbing his calculus instructor in class, waived his right to a preliminary hearing on Tuesday.
General District Judge Charles R. Cloud certified the charge of malicious wounding to the grand jury. If Malkamy is indicted, the case is expected to go to trial next month.
Malkamy, 21, is charged with stabbing Carl Panetta in the shoulder on July 7, 1994, during class. Panetta survived the attack. No motive has been given.
Cloud on Tuesday declined to allow two misdemeanor charges of assault to proceed against Malkamy. Those charges stemmed from alleged assaults on sheriff's deputies while Malkamy was being held in jail.
The judge's action occurred a day after he vowed to order the city and commonwealth's attorneys to explain why they should not be held in contempt for refusing to give volunteer prosecutors permission to try a jail beating in his court.
Eric W. Schwartz, Malkamy's attorney, said his client may enter a plea of not guilty by reason of insanity to the malicious wounding charge.
On the day of the attack, students said they saw Malkamy reach into his yellow school bag several times during class before pulling out what they described as a steak knife.
Malkamy made no attempt to flee after the attack, and appeared to be in shock, witnesses said. Malkamy was a part-time student in the computer science department, according to school officials.
