The U.S. 4th Circuit Court of Appeals in Richmond said it won't reconsider its decision that allows Bell Atlantic Corp. to sell cable-television programming in its local telephone territories, including Hampton Roads. The Justice Department and the cable television industry had asked for a rehearing of the Nov. 21 ruling by a three-judge panel of the court. The ruling upheld a landmark decision by U.S. District Judge T.E. Ellis II of Alexandria that overturned a federal ban against telephone companies selling video programming in their service areas.
