STORE MANAGER IS FINED $250 AFTER ENTERING OBSCENITY PLEA SEXUAL MATERIALS WERE SEIZED AFTER CITIZENS' PANEL FOUND THEM OBSCENE.

The manager of Oceana Video and News pleaded no contest Monday to a misdemeanor charge involving possession with intent to distribute sexual paraphernalia.

The paraphernalia - consisting of various sexual aids - was confiscated from the store's back room in March after a panel of citizens examined purchases made at the store and deemed them obscene.

The panel was appointed last year by Deputy Commonwealth's Attorney Albert Albieri. Items from five other stores were also declared obscene and confiscated.

Samuel Paul Moore, who managed Ocean Video, was charged ``because he was physically in the building'' when police came to confiscate the paraphernalia, said Moore's attorney, David Bouchard. He pleaded no contest because he ``just wanted to get on with his life.''

``My client is a quiet, nice old man who wasn't doing anything wrong,'' Bouchard said. ``The owners of the business made the decision (not to go to trial. . . In my opinion, the law was improperly enforced.''

Moore pleaded no contest in return for a $250 fine and no jail time. He has also forfeited the confiscated merchandise.

A separate defendant, Louis Krbec III, agreed to sell his three stores in return for no jail time and reduction of felony charges to misdemeanors. Two more cases are pending.
