The attorney for School Board member Charles W. Vincent will get extra time this week to file an argument that his client's conviction on criminal ethics charges should be set aside.
Attorney Andrew Sacks' brief was due in Circuit Court Wednesday. The deadline was extended until Friday.
Sacks is expected to argue in the brief that the commonwealth's attorney did not present evidence that Vincent intentionally violated a criminal ethics code when he solicited campaign contributions from businesses seeking school building contracts.
A jury convicted Vincent last month on all nine counts and recommended that he be fined $1,800.
Circuit Judge Thomas S. Shadrick is scheduled to rule Feb. 22 on whether to set aside the jury's verdict.
If the conviction is upheld, state law requires that Vincent step down from the board. Attorneys disagree, however, over whether Vincent would lose his seat immediately or could remain on the board during appeals.
