A grand jury has indicted 16-year-old Royale Lee Stewart on a charge of capital murder in the Feb. 10 slaying of a Hampton man who was talking on a pay phone outside a convenience store on Hampton Boulevard when he was shot.
Stewart, identified as the triggerman in the killing, also was charged with attempted robbery and two counts of firearm use. Two co-defendants - 20-year-old Gerald Crandle and 23-year-old Ocie Wilson - were charged with first-degree murder and robbery.
Kevin Gallegos, 29, was talking on a pay phone outside a 7-Eleven in the 4000 block of Hampton Blvd. when he was shot.
According to court records, the woman to whom Gallegos was talking on the phone heard him say, ``I'm sorry, I don't have any money.''
After Gallegos was shot, he ran into the convenience store, where he collapsed. He died soon afterward in a Norfolk hospital.
