A charge by a woman patient that a Portsmouth physician assaulted her during a 1994 breast examination was dismissed Tuesday by Judge William H. Oast in General District Court.
Dr. Jose D. Angeles, who has practiced medicine in Portsmouth for more than 25 years, was accused by a 29-year-old Portsmouth woman of kissing her body following an examination in November.
The woman testified that Angeles made the assault when he was alone with her in his examination room, located in Angeles' office at 3703 County St.
Oast dismissed the charge after the woman had difficulty remembering exactly when the offense allegedly occurred.
The woman admitted that she could not recall the exact time of the assault, but said the experience was traumatic regardless of when it occurred.
A similar charge against Angeles, 55, by another woman patient is not being prosecuted at this time by the Portsmouth commonwealth's attorney. The woman did not appear in court Tuesday.
According to Angeles' attorney, Earl Griffin, the second charge could be reinstated at a later date. Police reports say the second assault took place Feb. 14.
