CITY COUNCIL ACTIONS - PORTSMOUTH

The City Council took the following action at its meeting Tuesday:

Request by the city to rezone 12 acres of property from residential RM-60 and residential RM-60-K (conditional) to residential RS-60. The property is located in the 3300 block of Airline Boulevard and includes Hattonsville Estates and property to the west.

Use permit application of Churchland House for expansion of an existing residential care facility at 3911 Cedar Lane.

Approved, 7-0

Proposal to amend table 40-43.1-3, use schedule downtown districts, of the zoning ordinance to allow child day care centers within the downtown D-1 public subdistrict, with the issuance of use permit.

Approved, 7-0

Use permit application of Trinity Episcopal Church for a day care center at 500 Court St.

Approved, 7-0

Use permit application of the St. Mark Church of Deliverance for church activities at 609 Washington St.

Approved, 5-2; Griffin, Pitts opposed

Resolution authorizing the acting city manager to execute a sixth amendment to the Development Agreement with Portsmouth Parkside Development Associates for Phase II of the Crawford Condominium project. Deferred from the Sept. 12 regular meeting. The amendment would extend the completion date for this project to July 31, 1996.

Resolution authorizing the city attorney to submit an application to the U.S. Department of Justice for pre-clearance of the at-large election of the school board. The application is mandatory prior to making any change in the electoral procedures, a requirement of the Federal Voting Rights Act.

Ordinance to amend chapter 2 of the city code by amending sections 2-575 (b) and 2-582 (b) pertaining to administration, giving the Museum and Fine Arts Commission power to award grants to arts and cultural organizations.

Resolution approving a service agreement with the Hampton Roads Regional Jail Authority and with the member jurisdictions of the Authority. The agreement outlines the number of inmates which each locality must commit to the new jail, and it defines how the per diem rate for each inmate will be calculated. Portsmouth is now required to commit 250 prisoners to the regional jail and to maintain that number.

Resolution authorizing condemnation proceedings for a cemetery located within the block bounded by PortCentre, 5th Street, Madison Street and Edwards Street. There is a small cemetery located in the southside project to which the Housing Authority never acquired title. The Virginia Code does provide that cities can condemn such property for public purposes.

Motion to transfer $121,905 from the grants contingency account to continue the Portsmouth Community Corrections Program. The program is designed to provide investigation, supervision, and rehabilitation services to misdemeanant and non-violent offenders.
