The U.S. Supreme Court on Thursday rejected an appeal by death row inmate Herman Charles Barnes, clearing the way for his scheduled execution Monday.
Barnes, 31, was convicted of capital murder for killing two men in a 1985 attempted robbery in Hampton.
Barnes' execution was set for Oct. 5, but Gov. George Allen allowed a stay because of an illness in the family of one of Barnes' lawyers.
The high court rejected the appeal without comment.
The July 27, 1985, market shooting left the store's 73-year-old owner, Clyde Jenkins, and clerk Mohammed Afifi dead. Authorities said Barnes shot Jenkins three times and Afifi once.
At trial Barnes admitted he was involved but said an accomplice pulled the trigger. The accomplice was convicted of being a lookout and sentenced to 91 years in prison. by CNB
