The Albemarle Area United Way's former executive director is scheduled to appear in Currituck County Superior Court this afternoon on embezzlement charges filed last May.
James Graham Foreman Jr. faces 46 total counts of embezzlement and corporate malfeasance in connection with $102,000 diverted from United Way accounts from March 1993 through February 1995.
``They've agreed to a plea,'' Assistant District Attorney Mike Johnson said Wednesday. ``We're going to hear the plea and get that adjudicated. . . . The terms will be worked out and announced in court.''
Johnson declined to give the specifics of the agreement, saying he preferred to wait until they become official. Foreman's attorney, H.P. Williams Jr., could not be reached.
Foreman was suspended without pay in February 1995. He resigned a few days after United Way directors discovered a doctored version of the organization's annual audit report.
In his July answer to a civil lawsuit filed by the United Way, Foreman admitted to ``willfully, wrongfully and fraudulently'' diverting the funds for his personal use.
The criminal case is scheduled to come before Senior Resident Superior Court Judge J. Richard Parker at 2 p.m.
Johnson said Foreman would probably be sentenced at a later date. by CNB
