SPA'S FORMER CLIENTS MAY GET MONEY BACK

Former members of Hardbodies Health and Fitness, 544 Newtown Road, are eligible to cancel their memberships, according to the Virginia Department of Agriculture and Consumer Services, Office of Consumer Affairs.

Following the closing of the Newtown Road spa location, members were offered a transfer to the Hardbodies at the Hilltop Plaza Shopping Center. However, the distance between the two spas exceeds the five driving miles allowed by the Virginia Health Spa Act when memberships are transferred, thus allowing members to cancel.

An interim transfer to Fitness First, which was offered following the closing of the Newtown Road Hardbodies spa, is no longer in effect because the planned purchase of Fitness First by Hardbodies has fallen through.

Any members who wish to cancel must send written notice of their intention to cancel their memberships via certified mail, return receipt requested to Hardbodies Health and Fitness, 544 Newtown Road, Virginia Beach 23462. Following receipt of the cancellation, Hardbodies has 30 days to refund to the buyer all the money collected toward the unused portion of the membership term. In some instances, the refund will include part of the initiation fee as well.

In the event that Hardbodies does not provide the appropriate refunds within 30 days after receiving the notice of cancellation, consumers should contact the Office of Consumer Affairs to file a complaint. For more information, call 1-800-552-9963.
