HIGH COURT WON'T HEAR DEATH ROW APPEAL

The U.S. Supreme Court refused without comment Monday to hear the appeal of death row inmate Walter Mickens Jr.

Mickens' lawyers had asked the court to review whether a jury deciding between a death sentence or life in prison should have been told that Mickens would not be eligible for parole if sentenced to life in prison.

Mickens was convicted in 1993 of the attempted forcible sodomy and murder of Timothy Jason Hall, 17, whose body was found under a parking garage in Newport News on March 30, 1992.
