According to published reports, Boston-based mediator Eric Green is hearing arguments from lawyers representing Virginia Tech and Virginia Commonwealth University, as well as counsel for the 12 universities trying to expel Tech and VCU from the Metro.
The mediation came in response to a lawsuit filed by Tech and VCU in Richmond Circuit Court on January 17 to stop realignment of the Metro Conference. The other 12 schools in the conference had announced plans to expel Virginia Tech and VCU from the Metro.
The suit asks for determination of what the league owes Virginia Tech and VCU, who see the expulsion as an attempt by the Metro to avoid paying a $500,000 departure fee and shares of other conference revenue, such as TV fees and NCAA Tournament receipts.
The suit also asks for a temporary injunction to maintain the current conference alignment until the suit is resolved. If no agreement is reached in mediation, a temporary injunction hearing is scheduled to be held tomorrow, Feb. 3, at 9 a.m. in Richmond Circuit Court.
